These Terms & Conditions (“Terms”) apply to all services provided by Cova Concrete (“Contractor,” “we,” “us,” or “our”). By requesting services, signing a proposal or contract, or allowing work to proceed, the client (“Client”) agrees to be bound by these Terms.
All work is limited strictly to the scope described in the written proposal or contract. Any work not expressly included is excluded. Verbal discussions, assumptions, or prior representations are not binding unless incorporated into a written agreement signed by both parties.
Estimates are based on visible site conditions and information available at the time of inspection. Pricing may change due to concealed conditions, site access issues, soil conditions, code requirements, design changes, material price fluctuations, or changes requested by the Client.
Any modification to the scope of work must be documented in a written change order approved by the Client before additional work is performed. Change orders may affect project cost and schedule.
Payment terms are as stated in the written proposal or contract. Failure to make timely payments may result in suspension of work, project delays, and additional costs. Contractor reserves the right to recover collection costs, including reasonable attorney’s fees, as permitted by California law.
Project schedules are estimates only and are subject to weather conditions, inspections, material availability, site access, permitting delays, and other factors beyond Contractor’s control. Delays caused by these conditions do not constitute breach of contract.
Client is responsible for providing clear access to the work area, utilities, and a safe jobsite. Contractor is not responsible for damage to underground utilities, irrigation, drainage, or structures not properly disclosed or marked.
Client acknowledges that concrete is subject to natural cracking, shrinkage, expansion, settling, color variation, and surface imperfections. These are inherent characteristics of concrete and do not constitute defects or poor workmanship.
Contractor warrants workmanship for a period of one (1) year from project completion. This warranty excludes normal wear, cracking, soil movement, acts of nature, misuse, improper maintenance, or work performed by others.
Unless expressly stated otherwise, Client is responsible for permit fees and approvals. Contractor will cooperate with required inspections but is not responsible for delays caused by permitting authorities.
Contractor maintains required insurance in accordance with California law. To the fullest extent permitted by law, Contractor is not liable for indirect, incidental, or consequential damages.
Client agrees to indemnify and hold harmless Contractor from claims, damages, or losses arising from Client’s actions, site conditions, or failure to disclose relevant information.
Contractor reserves all rights to file a mechanics lien or pursue other legal remedies for non-payment as allowed under California Civil Code. This notice does not constitute a lien and does not replace any required preliminary notice.
Contractor may suspend or terminate work for non-payment, unsafe conditions, or material breach by Client. Client remains responsible for payment for work performed to date.
Any dispute arising from this agreement shall be governed by the laws of the State of California. Parties agree to attempt resolution in good faith before pursuing litigation. Venue shall be the county in which the project is located.
These Terms, together with the written proposal or contract, constitute the entire agreement between the parties and supersede all prior discussions or representations.
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
